Terms of Use

These Terms of Use ("Terms") govern your use of Whimsy, a platform that helps families discover, book, and manage after-school activities. By creating an account or using Whimsy, you agree to be bound by these Terms.

You must be at least 16 years old, or use Whimsy with a parent or guardian's permission, to create an account. You are responsible for keeping your account details accurate and secure, and for activity that occurs under your account.

• You may use Whimsy to discover, save, and book activities for your family.
• Bookings are made directly with the relevant activity provider, subject to their availability and terms.
• You agree to provide accurate information about your children, including date of birth and any relevant medical notes, so providers can deliver activities safely.

Payments are processed securely through our payment provider. Pricing, term structures, and cancellation policies are set by each activity provider and shown before you confirm a booking. Refunds are handled in accordance with the provider's published policy and applicable consumer law in New Zealand.

Providers are responsible for the accuracy of their listings, the safety of their programmes, and the qualifications of their coaches. Whimsy facilitates discovery and booking but is not the provider of the activities themselves.

• Do not misuse Whimsy, including by providing false information, disrupting the service, or attempting to access data you are not entitled to.
• Do not scrape, copy, or redistribute listings or content without permission.
• Respect other users, providers, and coaches.

The Whimsy name, logo, and platform design are owned by us. Activity listings, photos, and coach profiles remain the property of the relevant provider. You may not use our branding or content without written permission.

Whimsy is provided on an "as is" basis. We work hard to keep information accurate and up to date, but we do not guarantee that every listing, timetable, or availability detail is error-free. To the extent permitted by law, our liability is limited to the fees paid through the platform for the relevant booking.

We may update these Terms from time to time. We will notify you of significant changes within the app. Continued use of Whimsy after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.
