For activity providers

This Provider Agreement ("Agreement") sets out the terms under which independent activity providers ("Provider", "you") use Whimsy to list programmes and receive enrolments from families in New Zealand. Whimsy is a technology platform that connects families with independent activity providers — Whimsy is not itself an activity provider.
You remain solely responsible for delivering your programmes, including supervision, staffing, child safety, first aid, Health & Safety compliance, insurance, qualifications, risk management and emergency procedures.
Families book and pay through Whimsy. Whimsy facilitates the booking and processes payments via our payment provider (Stripe). You agree to honour confirmed bookings made through Whimsy.
Whimsy charges a commission on each successful paid booking processed through Whimsy. Your applicable rate — Founding Partner or Standard — is shown to you before publishing and is recorded on your account at the time you accept this Agreement.
Payments are processed by Stripe and payouts are made to your connected Stripe account according to Stripe's supported schedule. Whimsy is not responsible for Stripe's payout timing.
You are responsible for setting and honouring your cancellation and refund policies. Refunds are handled in accordance with your published policy and applicable New Zealand consumer law.
You retain ownership of your listing content. You agree to handle family information shared with you for a booking in accordance with the Privacy Policy and applicable privacy law. Playground owns the platform, name and logo.
Whimsy may suspend or remove listings that breach these terms or are misleading or unsafe. Either party may end this agreement at any time by closing the provider account.
We may update this Agreement and will notify you of material changes. This Agreement is governed by the laws of New Zealand.
